Vehicle History Report — Terms of Sale

These terms apply when you buy a Vehicle History Report on Cars for CommBank. Please read them before you pay. By confirming your purchase you agree to them.

1. Who you are buying from

The Vehicle History Report is sold to you by Vyro Pty Ltd (ABN 98 653 976 099) (“Vyro”, “we”, “us”). Vyro builds and operates the Cars for CommBank platform. We are the seller of the report and your contract for it is with us.
The report data is supplied to us by AutoGrab Pty Ltd (ABN 79 638 468 569). AutoGrab is our data supplier — it is not a party to your purchase.
Commonwealth Bank of Australia is not the seller of the report and is not a party to your purchase.

2. What the report is

The report sets out what our data sources recorded about the vehicle you searched, as at the date and time printed on the report. Depending on the vehicle and on what each source holds, it may include:
  • results of a search of the Personal Property Securities Register (PPSR), showing whether a security interest (for example, money owing on the vehicle) was registered at the time of the search;
  • whether the vehicle appeared on a written-off vehicle register or as reported stolen;
  • registration and identification details, such as make, model, build details, VIN and registration status;
  • other historical information held by our data sources.
Availability of each check varies between states and territories and between vehicles. Some information may not be available for the vehicle you search.

3. What the report is not

The report is a research tool. It is not an inspection, a valuation, a roadworthiness check, or advice about whether to buy a vehicle.
It is not a PPSR certificate issued in your name. A PPSR search certificate obtained in your own name may give you protections under the Personal Property Securities Act 2009 (Cth) that this report does not give you. You can obtain a certificate in your own name directly from the PPSR at ppsr.gov.au.
The report will not tell you about anything our data sources do not hold — including unreported damage, mechanical condition, odometer tampering that was never recorded, or a security interest registered after your report was generated.
We recommend you also inspect the vehicle, or have it inspected, before you buy.

4. Price and payment

The price of a Vehicle History Report is $22, including GST. That is the total amount payable — there is no separate booking, service or administration fee.
The $22 covers the report data supplied by AutoGrab and Vyro's costs in providing and supporting the report.
Payment is processed by Stripe. The price shown at checkout before you confirm is the price you pay. We may change the price of the report from time to time; a change never affects a report you have already bought.

5. Delivery and access

Reports are available to signed-in Cars for CommBank account holders only.
Your report is normally generated and available in your account within about a minute of payment. Occasionally a data source is slow or unavailable and it takes longer. We store your report in your account for 120 days from the date it is generated, after which it may be deleted. We suggest you download a copy if you want to keep it.
We do not email reports.

6. Each report is a point-in-time snapshot

A report records the position on the date and time it was generated. It is not updated afterwards. Circumstances change — most commonly, a security interest is discharged after a seller pays out their loan.
If you want the current position, buy a new report. Each report is charged separately at the price then shown; there is no discounted refresh.

7. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (“ACL”). Where the ACL applies and cannot be excluded, it prevails over anything inconsistent in these terms.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
How to make a claim. Contact us using the details in clause 12 and tell us your account email, the date of purchase and what has gone wrong. You bear any expense of claiming (for most claims this is nothing more than the cost of contacting us). We may ask you for the report or a screenshot of it.

8. Refunds

Separately from, and in addition to, your ACL rights, we will refund the full $22 if:
  • the report fails to generate, or does not become available in your account within 24 hours of payment;
  • you were charged more than once for the same report; or
  • the report is materially incomplete or unreadable.
Ask us within 30 days of purchase and we will process the refund to your original payment method.
Because the report is generated and delivered immediately, we cannot “un-supply” it, and outside the circumstances above and your ACL rights we do not generally refund a report you simply decided you did not need. If you think your situation warrants a refund anyway, tell us — we would rather hear from you than not.

9. Our responsibility

We will provide the report with due care and skill.
We do not promise that the report is a complete record of a vehicle's history, or that a vehicle is free of faults, damage or money owing that our data sources do not hold. What the report can show is limited by what those sources record.
Subject to clause 7, and to the extent the law permits, we are not liable for loss you suffer because a third-party data source's records were incomplete or inaccurate at the time of the search, or because the position changed after your report was generated.
AutoGrab, as our data supplier, may rely on this clause to the same extent as us.

10. Information you give us, and privacy

To produce a report we need vehicle details — typically a registration number, state, or VIN. We pass those details to AutoGrab and its data sources so the searches can be run, and we keep a record of your purchase and the report.
You must be entitled to search the vehicle you search. Do not use the service to search a vehicle for a purpose unrelated to buying, selling or owning it.

11. Using the report

The report is for your own use in connection with a vehicle you are considering buying, selling or own. You may share it with your own adviser, mechanic, insurer or financier.
You may not resell it, publish it, present it as your own, or extract data from it to build or supplement a database or another product.

We aim to acknowledge a complaint within 1 business day and resolve it within 10 business days. If we cannot resolve it to your satisfaction you can contact the Australian Competition and Consumer Commission (accc.gov.au) or your state or territory consumer protection agency — in New South Wales, NSW Fair Trading.

13. Changes to these terms

We may update these terms. The terms that apply to your purchase are the ones published at the time you paid, and later changes do not affect reports you have already bought.

14. Governing law

These terms are governed by the law of New South Wales, and you and we submit to the non-exclusive jurisdiction of the courts of that state.

15. General

These terms, together with the End User Licence Agreement and our privacy policy, are the entire agreement between you and us about buying a Vehicle History Report, and replace any earlier version of these terms. If any part of these terms is found to be unenforceable, the rest continues to apply. You can't transfer your rights or obligations under these terms to someone else; we may do so as part of a transfer of our business, or to a related company. Clauses 3, 7, 9, 11, 12, 14 and this clause survive after your purchase is complete.
