Website Terms of Use

These Website Terms of Use (“Terms”) apply to anyone who accesses or uses the Cars for CommBank website at carsforcommbank.com.au (the “Platform”), whether or not you have an account. They’re between you and Vyro Pty Ltd (ABN 98 653 976 099) (“Vyro”, “we”, “us”, “our”).
By using the Platform — including simply browsing it — you agree to these Terms. If you don’t agree, please don’t use the Platform.
If you create a Cars for CommBank account, list a vehicle, submit an enquiry in the Deal Room, or buy a Paid Product, our End User Licence Agreement also applies to that activity, and takes priority over these Terms to the extent of any inconsistency. These Terms continue to apply to your general use of the Platform alongside it.

About Commonwealth Bank's role

Vyro builds and operates Cars for CommBank. Vehicle sales made through the Platform are not conducted by CommBank, and CommBank is not responsible for vehicle sales, car listings or advertising appearing on the Platform.

1. Acceptable use

You agree not to:
  • attempt to gain unauthorised access to the Platform, or to any account, system or network connected to it;
  • use the Platform in a way that damages, disables, overburdens or impairs Vyro’s, VEME’s servers or networks;
  • access or attempt to access the Platform using a robot, spider, scraper, crawler or other automated means, or extract, harvest or compile Listings, pricing, images or other Platform data at scale, without our prior written consent;
  • circumvent, disable or interfere with any rate limit, access control, CAPTCHA, authentication requirement, robots.txt directive or other technical measure we use to control or monitor access to the Platform;
  • use data obtained from the Platform (whether or not obtained in breach of these Terms) to build, train or supplement a competing product or database, or to republish Listings on another platform, without our prior written consent;
  • use the Platform to infringe anyone’s rights, including intellectual property or privacy rights, or to harass, defraud or mislead another person;
  • use the Platform for any unlawful purpose, or in a way that breaches any law, industry code or regulation that applies to you; or
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity, in connection with the Platform.
If you want to access Platform data at scale for a legitimate purpose, contact us — we may agree a separate data licence.
We may block, restrict or deny access to the Platform to anyone we reasonably believe has breached these Terms. Automated or unauthorised access, or conduct that poses a security risk to the Platform or other people — including a breach of paragraphs (c) to (e) — is treated as needing immediate action, and we may act without prior notice. A breach of paragraphs (c) to (e) can also cause harm that isn’t adequately remedied by damages alone, so you agree that, in addition to any other remedy available to us, Vyro may seek an injunction or other urgent court relief for an actual or threatened breach of those paragraphs.

2. Content on this website

Content on the Platform — including its text, graphics, design, the Cars for CommBank branding, and the selection, arrangement and compilation of Listings and other data — is owned by Vyro or its licensors, to the extent protected by law, except where stated otherwise.
You may view and print pages from the Platform for your own personal, non-commercial use. You must not otherwise reproduce, republish, distribute, or commercially exploit any part of the Platform without our prior written consent.

3. Accuracy and no advice

We try to keep the Platform accurate and current, but we don’t guarantee it. Vehicle Listings are created by sellers, not verified by Vyro before they’re published — see the End User Licence Agreement for more on how Listings work. Nothing on the Platform is financial, credit, insurance or legal advice, or a recommendation to buy, sell or finance a particular vehicle.

4. Links to other sites

The Platform may link to websites we don’t operate, including third-party services like VEME. We’re not responsible for the content or practices of those sites, and a link doesn’t mean we endorse them.

5. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Subject to that, the Platform is provided on an “as is” and “as available” basis: we don’t promise it will be uninterrupted, error-free or free of defects, and to the maximum extent the law allows, Vyro isn’t liable for indirect, consequential or special loss (such as loss of profits, data or opportunity) arising from your use of the Platform. This clause doesn’t limit our liability for loss caused by our fraud or wilful misconduct, or for a failure to meet a consumer guarantee that can’t be excluded by law. CommBank, VEME and AutoGrab may each rely on this clause to the same extent as Vyro, as if they were a party to these Terms.

6. Changes to these Terms

We may update these Terms from time to time. We’ll post the updated Terms on this page with a new “Last updated” date, and material changes take effect from the date they’re posted.

7. Governing law

These Terms are governed by the law of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
